Simon Thomas

Simon Thomas has 25 years' litigation experience. His practice focuses predominantly on the defence of claims brought against solicitors, insurance brokers, barristers, IT professionals, accountants, estate agents and construction professionals.

Simon acts for a number of Lloyd's and London Market insurers and their policyholders, defending and resolving claims by way of litigation and through ADR / mediation.

He has undertaken secondments with three leading London Market insurers, advising on a range of domestic and international claims, and spent time with a London-based MGA assisting with the establishment of its claims function.

He provides non-contentious advice to insurers and policyholders on policy drafting, collateral warranties and general coverage matters, and has more recently advised on commercial matters for high net worth individuals and handled references to the Financial Ombudsman Service. Simon regularly produces articles on insurance and liability issues and provides training on a range of litigation and insurance topics.

  • 01Defending a firm of brokers over whether it had notified a blanket notification of circumstances on behalf of a policyholder
  • 02Successfully defending a firm of solicitors where a Claim Form had not been served in accordance with the Civil Procedure Rules
  • 03Pursuing a fees claim for a property agent and defending the resultant counterclaim alleging breach of fiduciary duty and fraud (£2.4m)
  • 04Defending a property agent against allegations of breach of trust and fiduciary duty arising from the allocation of company and property assets following a multi-million-pound divorce
  • 05Assisting a high net worth individual and an overseas company to defend a claim to ownership of UK property and an associated account and enquiry as to alleged lost rental
  • 06Successfully defending the liquidator of a company and its PI insurers in a claim arising from the Enterprise Finance Guarantee Scheme and associated mis-selling by RBS (£24m)
  • 07Representing an overseas-domiciled insurer to defend a series of claims under the Third Parties (Rights against Insurers) Act arising from pension advice by an IFA firm (£4.5m)
